AILA, ASISTA, CAST, and Freedom Network are currently working on collecting cases where trafficking survivors and other victims of crime have been negatively impacted on policy issues. We are looking for case examples that we may be able to share with DHS, USCIS, ICE, and/or other related government agencies. There are currently 2 types of cases we are collecting case examples on:
-
CASE TYPE 1: Cases where a T applicant was removed while USCIS was still processing the T visas. For these cases, we are primarily looking for cases where the applicant has already been removed. If you have one of these cases, please submit your case example to CAST here: https://airtable.com/shrPFX1dUzPi5gpid.
-
CASE TYPE 2: Case where a T visa, U Visa, or related NTA has been denied and an NTA has been issued. These cases examples should be shared in the AILA Story Collector: https://www.aila.org/advo-media/agency-liaison/case-examples/ntas-issued-as-a-result-of-usciss-new-nta-policy?fbclid=IwAR2WmvLWu-kC_K8sxkI-LVO_gqDe11T2eOui_VIfujXKsoc2kEKbiDcrD6s.
- CASE TYPE 3: T applicants currently in removal proceedings. If you have one of these cases, please submit a Technical Assistance (TA) Request here: http://bit.ly/CASTTaForm and explain the circumstances surrounding the applicant being placed in removal proceedings. Once you submit your TA request, please submit your initial cover letter, initial declaration, and RFE (if applicable).
For cases where there is pending removal or an NTA has been issued and you would like to know next steps, reach out to:
- ASISTA for individual case questions on immigration benefits for survivors. From the basic to the complex, we can help with any VAWA, U or T visas question that comes up in the course of your work. Individual case intervention (TA) with US Citizenship and Immigration Services and related agencies
- (https://asistahelp.org/membership/)
- CAST for T Visa or Trafficking Survivor Related Issues (http://bit.ly/CASTTaForm)
The more case examples we have, the more agency advocacy we’ll be able to do as a community.
